** The policies in this document supersede anything else written on this site. **

Terms & Conditions of Service & Limited Warranty

JTekNet warrants repairs for ten (10) days following the return of the computer to the client. If a failure occurs during the warranty period, service for the original problem only will be provided free of charge.

JTekNet does not warrant any hardware, if you have a problem with a piece of hardware manufacturer warranties apply.

The following are excluded from warranty service, and if provided by JTekNet shall be deemed billable service:

  • Repair work caused by customer misuse of the equipment
  • Work external to the equipment
  • Damage not caused by JTekNet, including, without limitation, damage caused by accident, transport, neglect, abuse, environmental conditions, lightning, failure or fluctuation of electrical power, use of equipment in a manner for which it was not intended or designed, and failure to follow manufacturer's recommendations regarding use of equipment.
  • Installations of upgrades or revisions
  • Repairs caused by software problems or by equipment not covered in this agreement
  • Repairs necessitated by attempted repairs by non-JTekNet personnel

Limitation of Liability

JTekNet disclaims all warranties, including all implied warranties of merchantability and fitness for a particular purpose. JTekNet shall not be liable to the customer or any other person for any loss or damage of any kind related to this agreement including, but not limited to, out-of-pocket expenses, any consequential damages, inconvenience, loss of data, loss of profits, loss of use, emotional stress, physical injury, life or damage to software or hardware, regardless of cause. Any right of customer to recover for loss or damages to property caused by JTekNet's fault or negligence shall be limited to the fair market value of the equipment prior to loss or damage. Any action against JTekNet must be brought within 1 month after the cause of action occurs.

  • JTekNet does not warrant that the software/service will meet customer's requirements, that operation of the software/service will be uninterrupted or error-free, or that the software/service will be corrected.
  • JTekNet is not responsible for problems caused by changes in the operating system characteristics of computer hardware or computer operating systems.
  • JTekNet assumes that software provided for installation (by the customer) is a fully and legally licensed copy of said software.
  • JTekNet reserves the right to refuse service to anyone.
  • JTekNet will hold computer as collateral or have a lien placed against owners assets upon failure to pay for services.
  • Client will be held responsible for all court fees and other miscellaneous fees should it be necessary to involve the legal system or collection agency to receive payments for services provided by JTekNet.
  • JTekNet will return any equipment taken from client in same (or better) physical condition as when received, and no hourly labor charges will be incurred if JTekNet deems they cannot handle client’s request. Mileage and bench fees are billable under any circumstance.

Disclaimers & Return Policy

  • JTekNet will not be responsible for any data loss while performing repairs, service, upgrades, virus cleaning, or network installations. The computer owner is responsible for backing up all data prior to service.
  • JTekNet is not responsible for any consequences from electrical surges and spikes. Computer owner is responsible for providing surge protection hardware.
  • JTekNet is not responsible for virus infections. It is the responsibility of the computer owner to make sure that the virus protection is enabled and up to date.
  • JTekNet is not responsible for incompatibility issues resulting from computer equipment not purchased from JTekNet.
  • Payment for services and associated fee's are due at time of delivery of equipment to client.
  • 30 Day return policy on hardware from date purchased or installed, receipt required other wise a credit will be issued. Must include all disks, cables, hardware, and paperwork. 15% restocking fee will be applied.
  • 15 Day return policy on unopened, factory sealed software, receipt required other wise a credit will be issued.
  • 15 Day exchange policy on opened software, exchanged for same title only (NO EXCEPTIONS)
  • 30 Day return policy on computer systems from date of purchase, receipt required, computer must meet specifications as when purchased. Must include all items received (keyboard, speakers, mouse, disks, paperwork, etc.) 15% restocking fee will be applied.
  • No returns or refunds on special orders or custom work.
  • Installation appointments will be made upon arrival of parts to be installed.
  • Client agrees, that once JTekNet and client have arranged a date and time for service that it represents a legally binding contract.
  • Diagnostic fee and mileage fees to be paid on initial visit or consultation. (Non-Refundable)
  • There will be a $25.00 charge for returned check fee.
  • We reserve the right to request a deposit

Referral Policy

Terms and Conditions

In order to utilize our referral program, you accept these terms.

The following are the terms and conditions of participating in the JTekNet Customer Referral Program. "Partner" refers to yourself, and "JTekNet" refers to us, JTekNet, 299 Bills Run Road, Jane Lew, WV 26378. This Agreement may be revised from time to time.

Commission and Payment

JTekNet will pay "Partner" a set commission for each new customer referral to JTekNet. The amount of the commission will vary depending on the type of service(s) that are to be provided the the new customer.

Partner commission shall be paid by check in US dollars. Partners will be paid between 30 and 60 days after new customer makes first payment for services performed.

As required by US Law, US Residents will be required to sign a W-9 form for the Internal Revenue Service before we can send your first payment.

All Customer Referral Program applications are subject to approval by JTekNet.

Referral Code

Upon acceptance, you'll be issued a "Referral Code", which allows us to identify new customers as originating from you. So long as a new customer uses your Referral Code when requesting a service, we will be able to identify the customer as originating from you. For you to receive Commissions, they must use your Referral Code.

JTekNet reserves all rights in or to its trademarks but may be used by Partner in accordance with this agreement. Partner may in no way display a JTekNet related logo, image, or trademark, which may be distasteful, defame, or misrepresent its brand. JTekNet has the right to specify how and if a trademark may be used by the Partner.

Partner shall take great care to not misrepresent JTekNet products or services.

Partner is solely responsible for ensuring that their referrals use the proper Referral Code.

Partner agrees to NOT SEND UNSOLICITED or SPAM mail to promote JTekNet services. This action is grounds for immediate termination of your account with a cancellation of any pending commissions.

Overview of Program

1) NO selling involved. All questions go directly to us. We even do the follow up.
2) NO Fees to get started.
3) NO processing of credit cards or customers to bill.

Non-Qualifying Referral Partners

Web Sites or other venues that promote: sexually explicit material or violence does not qualify as a Referral Partner. Sites that promote discrimination based on race, sex, religion, national origin, and physical disability, shall not be accepted. Sites that promote illegal activities shall not be accepted. By using the code given to you, you are stating that you do not and will not directly promote or endorse these activities while representing JTekNet.

Term of agreement

This agreement remains in affect until canceled by either party.

Commissions earned through the date of expiration or cancellation of this agreement will remain payable only if the qualifying sales are not canceled or refunded by the referred Customers and the Partner has not violated this agreement. Payment of the final Commission payment to the Partner may be withheld for a reasonable time in order to ensure that the correct amount is paid.

Disclaimer

JTekNet will make every reasonable effort to track and pay commissions for all sales that apply to Partner. However, JTekNet is not responsible for technical problems, Acts of God, acts by third parties, or other events outside our reasonable control, which may temporarily disrupt or diminish this service.

We will may every reasonable effort to identify the originating partner and credit them accordingly.

Privacy

To protect JTekNet customer privacy, we cannot provide identifying customer names and contact information to you. However, we will provide a report with each Partner payment detailing services provided and date of sale.

Independent Contractor

The relationship between JTekNet and Partner established by this Agreement is that of independent contractors. JTekNet and Partner shall each conduct its respective business at its own initiative, responsibility and expense, and shall have no authority to incur any obligations on behalf of the other, except as otherwise provided herein. Term "Partner" shall not be interpreted as a legal Partner, simply as an independent contractor for JTekNet under this agreement.

Warranty Disclaimer

JTekNet makes no warranties expressed or implied with regard to Customer Referral Program except as outlined in this agreement.

Limitation of Damages

JTekNet shall not be held liability for any indirect, incidental, special or consequential damages or any loss of revenue or profits arising under or with respect to this agreement or program, even if JTekNet has been advised of the possibility of such damages. JTekNet aggregate liability arising under or with respect to this agreement or the program shall in no event exceed the total commissions paid or payable by JTekNet under this agreement.

Partner understands that Referral tracking can never be 100% accurate and JTekNet is not responsible for inaccuracies that might occur beyond its control. Tracking of Referral sales depends on the referred customer providing the proper Referral Code. It is the goal of JTekNet to make Referral tracking as accurate as possible, however, JTekNet cannot guarantee 100% tracking for situations beyond its control.

Cancellation

JTekNet holds the right to cancel a Partner's account for any reason if deemed necessary. If the terms of this agreement were not violated by the Partner, then payment will be given to the Partner for any services provided to a new customer or outstanding commissions if the account is canceled by JTekNet.

Governing Law

The laws of the State of West Virginia and the United States shall govern this agreement.
